Abstract

This article examines the consequences of the Court of Justice of the European Union’s (CJEU) ruling in Achmea concerning Investor-State Arbitration (ISA) under intra- EU Bilateral Investment Treaties (BITs) from a treaty law perspective. It begins by briefly setting out the arguments of Advocate General Wathelet and the CJEU supporting their different positions on whether intra-EU BITs ISA clauses are compatible with EU law. The article then proceeds to analyse Achmea’s implications for intra-EU BIT ISA. It concludes that, as a result of the CJEU’s ruling, arbitral tribunals are deprived of their jurisdiction to entertain investors’ claims brought under intra-EU BIT ISA clauses. Finally, the article argues that Achmea’s applicability to cases brought under intra-EU BIT ISA clauses is limited, using the application of EU law as a relevant qualification. In order for an arbitral tribunal to be deprived of its jurisdictional competence as a result of Achmea, it must be entitled to interpret and apply EU law directly or indirectly in determining its jurisdiction.

Abstract

The paper is dedicated to the names of associations from the period of the Second Polish Republic, taken from a publication which is a guide to the rich and differentiated world of the social organizations of the 1930s.

The introduction is devoted to the state of Polish linguistic research into the names of organizations. The description of the collected material is based on the concept of social chrematonymy by Artur Gałkowski.

Next, the names are investigated from both a structural and a semantic perspective. The following elements are regarded as distinct qualities of the naming structures: descriptive character, multicomponent structure, development of right-sided attributives, insignificant share of names with a separate distinctive element, including some other types of proper names as components (toponyms, anthroponyms, names of historical events). Also, lexemes in the function of the main component of the analysed structures — nouns having the semantic value of ‘formalized group of people’ – have been presented.

When analysing the semantic aspect of names of organizations more closely, the author indicates the most frequently exposed bases of community feeling of members. Those could be: common experience, social and professional status, the purpose of activity, gender, generation, religious identity, nationality, ideology, place of activity or founding an organization. In the majority of names, various elements of community feeling are combined.

Finally, attention is paid to the tremendous informative value present in the names of associations, connected with their descriptive quality. The close link between socioideonyms and the reality they are connected with means that they are bearers of various historical-cultural contents.

Therefore, the names of associations, especially historical ones, might be an interesting object of culture-oriented linguistic studies.

Abstract

In elastic multibody systems, one considers large nonlinear rigid body motion and small elastic deformations. In a rising number of applications, e.g. automotive engineering, turning and milling processes, the position of acting forces on the elastic body varies. The necessary model order reduction to enable efficient simulations requires the determination of ansatz functions, which depend on the moving force position. For a large number of possible interaction points, the size of the reduced system would increase drastically in the classical Component Mode Synthesis framework. If many nodes are potentially loaded, or the contact area is not known a-priori and only a small number of nodes is loaded simultaneously, the system is described in this contribution with the parameter-dependent force position. This enables the application of parametric model order reduction methods. Here, two techniques based on matrix interpolation are described which transform individually reduced systems and allow the interpolation of the reduced system matrices to determine reduced systems for any force position. The online-offline decomposition and description of the force distribution onto the reduced elastic body are presented in this contribution. The proposed framework enables the simulation of elastic multibody systems with moving loads efficiently because it solely depends on the size of the reduced system. Results in frequency and time domain for the simulation of a thin-walled cylinder with a moving load illustrate the applicability of the proposed method.
