Abstract

Hardly any sector has been hit as hard by the COVID-19 pandemic as the air transport industry. As lockdown measures are lifted, a recovery phase begins that will shape the global economic landscape for the years to come. In this context this paper raises the question of whether the pre-existing EU instruments for subsidizing air operations – Startup aid and the Public Service Obligation – none of which was designed with economic recovery in mind – can be adapted to the new circumstances after the current ad hoc measures under the Temporary Framework have dried up. The hypothesis which is taken as a starting point is that the existing state aid toolbox has built-in deficiencies which are hampering recovery efforts. This paper therefore attempts to determine whether alternatives can be sought within the confines of the EU state aid law, and if so what such alternatives might be.

Abstract

In EU law a lot of attention has recently been paid to personal data protection standards. In parallel to the development of the general EU rules on data protection, the Members States also develop cooperation between law enforcement agencies and create new information exchange possibilities, including the processing of personal data of participants in criminal proceedings. The aim of this article is to analyse whether the personal data of victims of crime are safeguarded according to the standards of the Charter of Fundamental Rights. For this purpose, the author analyses two directives: 2012/29/EU, which regulates minimum standards of victims of crime; and 2016/680/EU (also known as the Law Enforcement Directive), which regulates personal data processing for the purpose of combating crime. Based on the example of the Polish legislation implementing both directives, the author comes to the conclusion that the EU legislation is not fully coherent and leaves too much margin of appreciation to the national legislator. This results in a failure to achieve the basic goals of both directives. The author expects the necessary reflection not only from the national legislator, but also from the European Commission, which should check the correctness of the implementation of the directives, as well as from national courts, which should use all possible measures to ensure that the national law is interpreted in the light of the objectives of the directives.

Abstract

This article examines the consequences of the Court of Justice of the European Union’s (CJEU) ruling in Achmea concerning Investor-State Arbitration (ISA) under intra- EU Bilateral Investment Treaties (BITs) from a treaty law perspective. It begins by briefly setting out the arguments of Advocate General Wathelet and the CJEU supporting their different positions on whether intra-EU BITs ISA clauses are compatible with EU law. The article then proceeds to analyse Achmea’s implications for intra-EU BIT ISA. It concludes that, as a result of the CJEU’s ruling, arbitral tribunals are deprived of their jurisdiction to entertain investors’ claims brought under intra-EU BIT ISA clauses. Finally, the article argues that Achmea’s applicability to cases brought under intra-EU BIT ISA clauses is limited, using the application of EU law as a relevant qualification. In order for an arbitral tribunal to be deprived of its jurisdictional competence as a result of Achmea, it must be entitled to interpret and apply EU law directly or indirectly in determining its jurisdiction.

Abstract

To produce the lime required for the Bayer process, two parallel flow regenerative shaft kilns (PFR) were used in the Iran Alumina plant located in Jajarm, North Khorasan Province, Iran. In this study, the calcination conditions of limestone were modelled in a laboratory furnace by considering three factors of limestone size, temperature and calcination time using the Box-Behnken method. The calcination model of limestone was obtained using a quadratic equation. Due to the importance of limestone dust in the performance of industrial kilns, conditions of calcification and its reactivity with water were examined at three temperature ranges of 800, 1000, and 1200°C, by two methods of titration and standard ASTM C110. The results indicated a decrease in reactivity of lime relative to the increased temperature of calcination and the lack of forming the burnt lime particles that stick together (blocking). Finally, the ratio of input limestone (kg) to fuel (m3) was reduced from 16.4 to 15.3 to increase the average temperature of the burning zone to 1000°C. Also, excess air was reduced from 40 to 20%. In this condition, the lime quality was increased by about 6% in the kilns.

Abstract

Contamination of the natural environment with petroleum pollution is still a frequent and particularly dangerous phenomenon, thus there is a need to remove these pollutants. Various types of mineral sorbents (silicate minerals, zeolites, perlite, diatomite, clay rocks) are highly valued in remediation processes due to their affordable, big selectivity and high efficiency. However, many sorbents are not resistant to moisture, which limits their use. The hydrophobization process improves the effectiveness of sorbents used in a humid environment. The DAMSORB produced by IM-POL was hydrophobized with a methanolic stearic acid solution. The use of cheap stearic acid as a modifier is economically advantageous. The evaluation of the hydrophobic properties of the modified material was performed on the basis of the results obtained from the tests: water absorption, floating on the water surface and the contact angles were determined. Tests of the sorption of petroleum-derived compounds were performed on the basis of three procedures: in accordance with the technical sheet of the leading producer of hydrophobic sorption materials in Poland, the Westighouse’s method in the oil layer and the Westighouse’s method on a flat surface. The modified sorbent floats on the surface of the water very well. The average value of the contact angle for the modified sample is 104 degrees. Material is super hydrophobic. In the water environment, the hydrophobized samples have a higher absorption capacity in relation to oil contaminations compared to the raw material. Features of the modified sorbent, such as good buoyancy on the water surface, low affinity to water and better absorption of oil from the solution, make it possible to use the material to remove petroleum contamination from water and highly moist surfaces.

Abstract

In the process of development and modernisation or updating lands or buildings register database the knowledge of the accuracy of analytical determination of areas is required. The knowledge of accurately determined areas is also indispensable for other activities, as e.g. in the case of geodetic maintenance of investments or in the process of control of direct subsidies for agriculture, which are performed within the Integrated Administration and Control System (IACS). In the case of double determination of area of an object, basing on co-ordinates of its vertices, determined from two independent measurements of the same accuracy, the results of calculations differ from one another. The value of that difference, generated in the natural way - following the law of error propagation - should be discussed with respect to its permissibility. This paper presents the analysis of technical and legal regulations, which are obligatory in Poland and which concern permissible errors of analytical determination of areas. Then, a method of determination of values of permissible differences of double determination of areas of cadastral (and other) objects basing on co-ordinates of vertices, under the assumption that those areas are determined with obligatory accuracy (i.e. which total error of position of a point does not exceed O. I O m) and with consideration of shapes of a geometrical object and its area is presented. A formula, which defines the maximum value of the permissible difference of double calculation of an area, which is the function of the parcel area, its shape and the accuracy of determination of position of vertices, has been proposed. Results obtained with the use of the proposed formula were then compared with those obtained with the use of the formula, which recently is obligatory in Poland, as well as other formulae acquired from professional literature. It has been proved that in order to record areas of cadastral objects according to existing regulations, the accuracy of determination of position of border points, should be considerably improved.

Abstract

The law is not effective in forcing the advertisers to communicate complete and reliable information about advertised products: the mere inclusion of written disclosures does not guarantee their successful perception, let alone comprehension. TV commercials are especially troublesome in this respect, because not only are the disclaimers presented in microscopic font size, but their display time challenges the perceptive abilities of even the most effi cient readers, not to mention the distracting effect of the simultaneously presented visual images and voice-overs. Yet, their effective comprehension could very often significantly modify the overall message and in this way lead to altered (often in a way unfavourable for the advertiser) persuasive effect. The study presents the ways in which the small print components interact with the information presented by means of the more conspicuous linguistic and pictorial items in a collection of 20 Polish TV commercials for erection stimulants. In particular, attention is given to the potential changes in the communicated message in the conditions of full comprehension and intake of the small print items.

Abstract

The article discusses the complex relations between the three different areas of culture and language in the Swiss canton of Grisons and describes the historical processes that have created this situation. The developing of the diversity of languages and cultures on the territory of Grisons was infl uenced to a high degree by the mountainous confi guration of this region, the isolation of the alpine valleys and by the situation of Grisons on the border line between the territories of the German and Romance cultures and languages. So the linguistic landscape of the canton of Grisons is composed nowadays of areas of German, Italian and Romansh. The peculiarity of Grisons is the existence of Romansh, one of the most ancient languages of the Alps. This Romance language was in the 5th century the only language used in Grisons, but has lost his dominant position to German and today it is struggling for its survival.

Abstract

The use of foreign language elements in advertisements is quite a common practice. Therefore, a large number of publications on this topic comes as no surprise. However, for the study purposes the researchers apply different perspectives and points of reference when it comes to defining what actually constitutes the use of foreign-language elements. The present paper offers a short review of those approaches, showing the discrepancies between various standpoints. It also addresses the methodological difficulties related to the application of clear-cut definitions. Given the variability of standpoints, it is suggested that the issues outlined in the paper need to be taken into consideration before any attempts are made at comparing the results of different studies of the problem.

Abstract

The paper addresses the issue of culture shock and the challenges met in the process of adaptation to a new culture, as experienced by international students studying in Poland. Until recently, Poland has not been regarded as a very attractive educational market. Poland joining the EU in 2004 contributed to a surge in various types of migrant arriving in the country, including international students. However, for the last few years the number of young people coming to Poland in order to study has been growing steadily. Yet, this growth does not mean that state, local or university authorities have any knowledge of how to resolve possible future conflicts which might and often do arise between overseas students and the society which receives them, or of how to help these students with their everyday problems. This dilemma is the result of a lack of studies regarding this group. Previous studies regarding migrants in Poland were only slightly focused on international students. In spite of the fact that international stu-dents are migrants, they differ significantly from other types of migrant – mostly those who are in Poland for economic or political reasons. The aim of the research presented in this article was therefore to carry out an initial exploration of the problems which this group encounters both at university and in society. The research was carried out in two stages with medical students in Łódź. The first stage was a paper-based questionnaire completed by international students studying at the Medical University of Łódź (N=74). The second stage involved three focus-group interviews conducted with some of these students.

Abstract

In the present study performance of an airflow window in removing contaminants as well as providing thermal comfort for the occupants was investigated. Both natural/mixed ventilation methods were studied and the full heating load as well as contaminant sources in the office rooms considered. Then, the local and average temperature, relative humidity, velocity as well as CO2 and dust concentration were extracted from simulation results and compared to criteria in international ventilation standards. It was found that except in the big room having 8 m×6 m flooring, natural ventilation from the airflow window can satisfy the thermal and relative humidity conditions in the international ventilation standard except for the American Society of Heating, Refrigerating and Air-Conditioning Engineers. However, the thermal comfort in the room which was measured by extended predicted mean vote could not be achieved when the window operates in the natural ventilation mode, even with a 0.4 m height opening in the small (3 m×4 m) room. Finally, results indicated that the airflow ventilation system installed in small and medium offices operation can provide indoor condition in the ventilation standard either in natural/mixed operation mode consuming less energy than the traditional heating, ventilation, and air conditioning. Besides, the airflow system not only was not able to provide thermal comfort condition in the big office but also its application was not economically feasible.

Abstract

A single acoustic vector sensor (AVS) cannot be used to find the direction-of-arrival (DOA) of two or more coherent (fully correlated) sources. We have proposed a technique for estimating DOAs (in 2D geometry) of two simultaneous coherent sources using single AVS under the assumption that acoustic sources enter in the field sequentially. The DOA estimation has been investigated with two different configurations of AVS, each consisting of three microphones in a plane. The technique has been also applied in tracking (a) an acoustic source in the presence of stationary interfering coherent source and (b) two coherent sources when the sources are changing their locations alternatively. The experimental environment has been generated using the Finite-Element Method tool viz. COMSOL to corroborate the proposed scheme.

Abstract

The present studies aimed at comparing the effect of the potassium monoionic form (prepared from a model spent ion exchanger) and a conventional potassium fertilizer (KCI) on plant vegetation after addition to depleted soil. To achieve the study aim a pot experiment using orchard grass (Dacrylis glomerata L.) as the test plant was carried out. The vegetation cycle lasted seven weeks. The plants were grown on four series of media: on untreated soil, on soil with added monoionic K form, on soil with added KCI and on soil with Biona-312 substrate added (2% v/v). Biona-312 served as the control fertilizer containing all macro- and microelements. The application of monoionic potassium form positively influenced orchard grass vegetation. The addition of K form into soil increased stem wet and dry biomass, root dry biomass and total dry yield by 15, 10, 13 and 12%, respectively. Bearing in mind that the amount of dry plant matter as source material for humus formation is crucial in soil reclamation, the effectiveness of potassium monoionic form was found to be similar to that of the mineral fertilizer - KCI. Biona-312 was the most efficient fertilizer used in the study, resulting in the greatest yield of Dactylis glomerata L.

Abstract

This article presents the results of an assessment of the potential for the use of CNG in Poland as a fuel for passenger cars powered by an internal combustion engine fuelled by petrol or diesel. The basis for assessing the potential was an analysis of the economic efficiency of converting a passenger car fuelled by petrol or diesel to a dual-fuel vehicle by installing a CNG system. On the basis of available literature data, the vehicle structure was characterised using the following criteria: vehicle age, engine capacity, car-segment, type of fuel used and kerb weight. The average fuel consumption (petrol or diesel) of the vehicle before conversion was determined on the basis of specially developed statistical models. The conversion and operating costs of a vehicle fuelled with conventional fuel and with CNG (after vehicle conversion) were estimated on the basis of a stochastic simulation model using probability density distributions of vehicle parameters and the Monte Carlo method. The vehicle parameters were estimated so that the obtained set of vehicles reflected the actual structure of passenger cars in Poland. The estimated costs of vehicle conversion (purchase and installation of a CNG system) and its subsequent operating costs made it possible to assess the economic efficiency of the car conversion process. The potential use of CNG as a fuel for combustion cars was estimated by comparing the operating costs of a vehicle before conversion and the operating costs of a vehicle after conversion, taking into account the costs of conversion. Analogous calculations were carried out for the conversion of a vehicle to run on LPG, i.e. the most important competitor to CNG.

Abstract

An algorithm of determination of mechanical stresses and deformations of the magnetic circuit shape, caused by forces of magnetic origin, is presented in this paper. The mechanical stresses cause changes of magnetizing characteristics of the magnetic circuit. The mutual coupling of magnetic and mechanical fields was taken into account in the algorithm worked out. A computational experiment showed that it was possible to include the interaction of both fields into one numerical model. The elaborated algorithm, taking into account the impact of mechanical stresses on magnetic parameters of construction materials, can be used in both the 2D and the 3D type field-model.

Abstract

There is a cascade of hydroelectric power plants built on the Váh River. From a water-management point of view, the natural channel is used to drain extreme discharges. During most of the year, discharges are regulated by water-management structures. These discharges are not used for energy-related purposes; therefore, it is important to determine the optimal discharge that will not negatively affect the ecosystem of the stream. The minimum balance discharge (hydro-ecological discharge) was determined based on the instream flow incremental methodology (IFIM) using the riverine habi-tat simulation system (RHABSIM). Input data were obtained from direct measurements on three reference reaches in the area between the cities Piešťany and Nové Mesto nad Váhom. Hydraulic flow characteristics were derived from three measurements at different water levels. Habitat quality was represented by ichthyofauna. Data to determine the habitat suit-ability curves of fish were obtained using a diving technique to collect video footage. The modelling resulted in the quanti-fication of the effect of discharge on ichthyofauna as a bio-indicator of habitat quality, which implied the need of 20 m3∙s–1 for a minimum balance discharge in summer.

Abstract

Re-delimitation of rainfall regions plays an important role in determining the rainfall pattern of an area. This study aims to reconstruct the delimitation of rainfall regions for the western region of Peninsular Malaysia. This study involved only the collection of rainfall data at 133 stations from 1960 to 2010. These data were obtained from the Department of Irrigation and Drainage, Malaysia. The analysis methods applied include kriging, contouring and topology using a geographical information system. The results showed that the new delimitation of the western region has been formed with an area reduction of 10% compared to the original western region found by Dale. This is due to some areas in the western region have not received rainfall between 2540 and 2794 mm. The area that getting the rainfall between 2540 and 2794 mm is 46,413.6 km2, in contrast to the sized of Dale’s western region of 51,596.2 km2. The area that frequently getting rainfall of between 2540 and 2794 during 1960s to 2010 are Parit Buntar, Taiping, Kuala Kangsar, Ipoh, Teluk Intan, Tanjong Malim, Batang Kali, Cameron Highlands, Subang, Petaling Jaya, Klang, Kajang and Bangi. The new delimitation formed through this study can be used as a guide by the agencies that manage water resources in Perak, Selangor and Negeri Sembilan in planning a more efficient water supply system.

Abstract

Lakes can be restored by the aeration method with the use of wind driven pulverising aerators. The method allows for moderate oxygenation of hypolimnion waters and it may be part of an integrated surface waters restoration system. The paper attempts to use the author’s method of maximum wind speeds to assess the volumetric flow of water through the aerator pulverisation mechanism. The study was conducted in 2018 in windy conditions of Lake Swarzędzkie. The introduction to the paper includes the characteristic of the lake and discusses the construction and operation of the wind driven pulverising aerator. Based on the maximum wind speed model, the theoretical capacity of the machine was calculated, which in the conditions of Lake Swarzędzkie was less than 111,500 m3 per year. Based on maximum wind speeds, the method of assessing the efficiency of the wind driven pulverising aerator is suitable for determining the volumetric flow rate of the pulverisation unit. This can significantly facilitate the planning of water reservoir restoration.

Abstract

In the present research, a scripting cartographic technique for the environmental mapping of Ethiopia using climate and topographic datasets is developed. The strength of the Generic Mapping Tools (GMT) is employed for the effective visualisation of the seven maps using high-resolution data: GEBCO, TerraClimate, WorldClim, CRUTS 4.0 in 2018 by considering the solutions of map design. The role of topographic characteristics for climate variables (evapotranspiration, downward surface shortwave radiation, vapour pressure, vapour pressure deficit and climatic water deficit) is explained. Topographic variability of Ethiopia is illustrated for geographically dispersed and contrasting environmental setting in its various regions: Afar, Danakil Depression, Ethiopian Highlands, Great Rift Valley, lowlands and Ogaden Desert. The relationships between the environmental and topographic variables are investigated with aid of literature review and the outcomes are discussed. The maps are demonstrated graphically to highlight variables enabling to find correlations between the geographic phenomena, their distribution and intensity. The presented maps honor the environmental and topographic data sets within the resolution of the data. Integration of these results in the interpretation maps presented here brings new insights into both the variations of selected climate variables, and the topography of Ethiopia.

Abstract

This work aimed to evaluate the yam peel in a bed column packaged as a chromium(VI) ion adsorbent in an aqueous solution. Yam peel was used as adsorbent, prior washing, drying, size reduction, and selection. The experimental work consisted in determining the effect of bed depth, particle size, and temperature, keeping inlet flow = 0.75 cm 3∙s –1, pH = 2 and initial concentration of 100 mg∙dm –3. The Adsorption Scanning Electron Microscopy (SEM) and Energy Dispersive X-ray (EDS) analysis on yam ( Dioscorea rotundata) peel showed a heterogeneous, porous structure, with functional groups characteristic in lignocellulosic materials. It was analysed regarding the influence of temperature, bed height, and adsorbent particle size on the removal efficiency; it was found that the decrease of particle size and the increase of the bed height favour the elimination of the metallic ion, with removal rates between 92.4 and 98.3%. The bed maximum adsorption capacity was 61.75 mg∙g –1, and break time of 360 min. The break curve’s adjustment to the Thomas, Yoon–Nelson, Dose–Response and Adams–Bohart models was evaluated, concluding that the Yoon–Nelson and Dose–Response models best described the behaviour of the break curve with a coefficient of determination ( R2) of 0.95 and 0.96, respectively. The results show that the bio-adsorbent studied can be used to eliminate Cr(VI) in a continuous system.

Abstract

The cyclic Electrothermal Temperature Swing Adsorption (ETSA) process in a fixed-bed column with Supersorbon K40 activated carbon (AC) was applied to remove propan-2-ol (IPA) from air. The bed was electrothermally regenerated using direct resistive heating method. The tests were performed in the range of operating parameters: IPA loading 0.18-0.26 kg/kg, voltage 19.5 V, set-point temperature 393–403 K, nitrogen flow rate 0.12 m3/h.

The analysis revealed, that raising the bed temperature resulted in an increase of desorption degree of adsorbate, reduction of regeneration time and an increase in the energy consumption. The application of insulation enabled reduction of energy consumption and regeneration time by 27% and 10%, respectively.

Abstract

Azo dye is widely used in the textile industry since it is cost effective and simple to use. However, it becomes a continuous source of environmental pollution due to its carcinogenicity and toxicity. Various methods had been used to remove the azo dye in solution. One of the famous and frequently used is the Fenton process. The Fenton process is one of the advanced oxidation processes where iron catalysed hydrogen peroxide to generate hydroxyl radical. Treating azo dyes in solution requires a catalyst to enhance the process of degradation. Herein, high entropy alloys (HEAs) have been proposed as a catalytic material to enhance the performance of Fenton process for azo dye degradation. HEAs have been reported as a promising catalyst due to its high surface area. The higher the number of active sites, the higher the rate of azo dye degradation as more active sites are available for adsorption of azo dyes. The results have shown that HEAs can be used as a catalyst to fasten the Fenton reaction since the degradation time is proven to be shorter in the presence of HEAs. The method derived from the result of this study will contribute in treating azo dyes for wastewater management in the Fenton process.
